يتناول هذا البحث مفهوم العقوبة وغاياتها من منظور فلسفي، ويستعرض تطور وظيفة العقوبة وأهدافها على مر التاريخ، بدءًا من المجتمعات القديمة وصولًا إلى العصر الحديث بهدف الإجابة على الإشكالية المتعلقة بوظيفة العقوبة كوسيلة لتحقيق الأمن والاستقرار في المجتمع، وهل هي وظيفة ردعية أم إصلاحية أم وظيفة أخرى.
يستعرض البحث آراء الفقهاء والفلاسفة المختلفين في تحديد أهداف ووظيفة العقوبة، بدءًا من المدرسة التقليدية التي نادت بوظيفة المنفعة (الردع العام والخاص) والعدالة، مرورًا بالمدرسة الوضعية التي نادت بالوظيفة الإصلاحية والاهتمام بشخص المجرم، وصولًا إلى مدرسة الدفاع الاجتماعي التي نادت بإلغاء العقوبات واستبدالها بتدابير إصلاحية.
يتطرق البحث إلى مفهوم العقوبة في المجتمعات القديمة ومرحلة القرون الوسطى، حيث كانت العقوبات تتسم بالوحشية والقسوة، سواء بفكرة الانتقام أو التكفير عن الذنب. ثم ينتقل البحث للحديث عن العقوبة في عصر النهضة والعصر الحديث، حيث ظهرت أفكار جديدة حول أغراض العقوبة وأهدافها، مع التركيز على تحقيق العدالة والإصلاح والردع.
يخلص البحث إلى أن العقوبة يجب أن تكون متوافقة مع الجريمة المرتكبة، وأن تراعي البيئة الاجتماعية والظروف المحيطة بالمجرم. كما يؤكد على أهمية تحقيق التوازن بين وظيفة الردع ووظيفة الإصلاح في العقوبة، بهدف الوصول إلى مجتمع آمن ومستقر.

Abstract:
This research examines the concept of punishment and its aims from a philosophical perspective. It reviews the evolution of the function and objectives of punishment throughout history, starting from ancient societies to the modern era, with the aim of answering the question of whether punishment is a means of achieving security and stability in society, and whether it is a deterrent, a reformative, or another function.
The research reviews the views of various jurists and philosophers on defining the purposes and functions of punishment, starting with the traditional school, which advocated for the function of utility (general and specific deterrence) and justice, through the positivist school, which advocated for the reformative function and attention to the criminal, and finally the social defense school, which advocated for the abolition of punishments and their replacement with reformative measures.
The research examines the concept of punishment in ancient societies and the Middle Ages, where punishments were characterized by brutality and cruelty, whether based on the idea of revenge or atonement for sin. The research then turns to discussing punishment in the Renaissance and modern eras, where new ideas emerged regarding the purposes and objectives of punishment, with a focus on achieving justice, reform, and deterrence. The study concludes that punishment must be consistent with the crime committed and take into account the social environment and circumstances surrounding the offender. It also emphasizes the importance of achieving a balance between the deterrent and reformative functions of punishment, with the goal of achieving a safe and stable society.
